Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Himachali Property platform — including the mobile application and website ("Platform") — provided by Himachali Connect, a brand operated by RajatWeb Technologies ("we," "us," or "our"). By using the Platform, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 18 years of age to create an account or post listings.
• You must have the legal right to list, sell, or rent any property you post on the Platform.
• By using the Platform, you confirm you are legally competent to enter into binding agreements under Indian law.

2. Account Registration

• All account information must be accurate, current, and complete.
• You are responsible for maintaining the security of your account credentials.
• You must immediately notify us of any unauthorized access to your account at app@himachaliconnect.com.
• One person may not create multiple accounts for the same property or to bypass Platform restrictions.

3. Property Listings

3.1 Accuracy & Honesty

• All listing details — price, size, location, type, and description — must be accurate and truthful.
• Photographs must represent the actual property being listed.
• You must not post a listing for a property you do not own or are not authorized to sell/rent.
• Duplicate listings for the same property are prohibited.

3.2 Prohibited Listings

• Properties with disputed ownership or under active legal litigation (without disclosure)
• Agricultural land being sold for non-agricultural purposes without requisite government permission under HP land laws
• Properties acquired through fraudulent or illegal means
• Any listing that violates applicable laws of Himachal Pradesh or India

3.3 Listing Removal

We reserve the right to remove any listing that violates these Terms, is reported as fraudulent, or is otherwise deemed inappropriate, without prior notice.

4. Platform Role — Intermediary Only

• Himachali Property is a listing and discovery platform only. We are not a real estate agent, broker, or party to any property transaction.
• We do not verify the legal status, title, or encumbrances of any listed property.
• All property transactions are strictly between the buyer/renter and the seller/landlord.
• We strongly recommend engaging a licensed lawyer for due diligence before any property transaction.
• We are not liable for any dispute, financial loss, or legal issue arising from a transaction arranged through the Platform.

5. HP Land Law Compliance

• Listings must comply with the Himachal Pradesh Tenancy and Land Reforms Act and all related state and central legislation.
• Non-Himachali individuals intending to purchase agricultural or orchard land must obtain Section 118 permission from the HP government. Such land should not be listed or sold without this approval.
• We reserve the right to flag or remove listings that appear to violate HP land laws.

6. Prohibited Conduct

You agree not to:

• Post fraudulent, fake, or misleading property listings.
• Contact other users for any purpose other than genuine property enquiry.
• Use the Platform to collect user data for external marketing.
• Impersonate another person or entity in listings or communications.
• Attempt to bypass Platform enquiry systems to spam users directly.
• Use automated tools to scrape data from the Platform.
• Post content that is defamatory, obscene, or illegal.

7. Payments and Premium Listings

• Basic listings may be free. Featured or promoted listing plans may require payment.
• All payments are processed through secure third-party gateways.
• Listing fees are non-refundable once a listing has gone live, unless the listing was rejected due to a Platform error.
• We reserve the right to change pricing with reasonable notice.

8. Intellectual Property

By uploading photos, videos, or descriptions to the Platform, you grant RajatWeb Technologies (operating brand Himachali Connect) a non-exclusive, royalty-free license to display and use that content on the Platform and in related promotional materials. You retain ownership and may request removal by deleting the listing or your account.

9. Disclaimer of Warranties

The Platform is provided "as is." We make no guarantees regarding the accuracy of listings, the availability of properties, or the outcome of any property transaction. Use the Platform at your own risk and discretion.

10. Limitation of Liability

RajatWeb Technologies and its brand Himachali Connect are not liable for:

• Any financial loss arising from a property transaction facilitated through the Platform.
• Inaccurate listing information provided by other users.
• Legal disputes over property titles or land rights.
• Service interruptions due to technical failures, maintenance, or force majeure.

11. Indemnification

You agree to indemnify and hold harmless RajatWeb Technologies, Himachali Connect, and its team from any claims, losses, or expenses (including legal fees) arising from your use of the Platform, your listings, or your violation of these Terms.

12. Termination

• We may suspend or terminate accounts that violate these Terms, with or without notice.
• You may delete your account at any time — see Delete Account page.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Himachal Pradesh, India.

14. Changes to These Terms

We may update these Terms. Continued use of the Platform after changes constitutes acceptance. Material changes will be notified via in-app notification.
